Government Reveals Environmental Control Strategy for Job Creation Law in UNDIP DIL Webinar

Through the Director of Business Environmental Impact Prevention and Activities of the Directorate General of Forestry Planning and Environmental Management of the Ministry of Environment and Forestry, the government representative Ir Ary Sudijanto M SE revealed the environmental impact control strategy regulated in Law Regulations Number 11 of 2020 on Work Creation. It was also stated in the forum that environmental control was getting stronger because it was supported by high technology in its supervision and implementation.
In the National Webinar held by the Diponegoro University (UNDIP) about Environmental Science Doctoral Program (DIL) on Wednesday, November 25, Ary Sudijanto stated that environmental control, which was originally based on licensing in the Job Creation Law was changed to be risk-based. The change does provide convenience but does not change the commitment to protecting the environment.
According to Ary, for businesses that have a big risk, there is still a need to attach an environmental impact analysis, while for those with a small risk, environmental supervision is included in the Business Identification Number. In making an environmental impact analysis, the government involves the community in a broader sense in public consultations and announcements.
In essence, the Job Creation Law covers all environmental aspects, be it environmental permits, environmental impact analysis for industry, management permits, and others. In the Job Creation Law, there is also a division of types of businesses and/or activities based on Law documents. The government is currently deploying an aspiration team to seek improvements in its implementation.
Concerning criminal sanctions in their application, it is confirmed that they still exist, especially as sanctions for defamation. Meanwhile, administrative fine provisions are also made with separate calculations that make more sense. For example, wastewater quality standards related to administrative sanctions will be calculated based on errors. Even about health, safety, and the environment, there are administrative sanctions for repair and fines for companies. “So, this Law Regulations (Job Creation Law) does not weaken the environment but wants to strengthen the environment instead,” he explained.
As it is well known, environmental problems are one of the sectors affected by the implementation of the Work Creation Law. Many elements were originally regulated in the Environmental Law changing. Responding to this condition, the UNDIP Environmental Science Doctoral Program held a National Webinar to find solutions to potential problems due to these changes.
Dean of the UNDIP Postgraduate School, Dr. RB Sularto SH MHum stated that Law Regulations Number 11 of 2020 concerning Job Creation is like a newborn and is treated in various ways in his opening speech. Considering that the law has not been implemented, the impact cannot be seen.
This webinar is expected to provide academic input on the birth of the Job Creation Law so that it can predict potential environmental impacts. “I hope that the participation of participants and interviewees will provide an input and become the materials that can produce future studies,” hoped Sularto.
Those who became the interviewees for this webinar are the Director of Business Environmental Impact Prevention and Activities of the Directorate General of Forestry Planning, Environmental Management of the Ministry of Environment and Forestry Ir Ary Sudijanto M SE, and there is also the General Chairperson of DPP Inkalindo (Indonesian Association of Environmental Assessors) Dr. Poerna Sri Oetari MSi , as well as Lecturer at the Faculty of Law UNDIP, Dr. Lita Tyesta ALW SH MHum. The webinar was moderated by the Head of the Environmental Science Doctoral Study Program, Dr. Hartuti Purnaweni MPA.
